Southern Showdown 2019 – UK Competition Terms and Conditions
The promoter is Sazerac UK Limited trading as Hi-Spirits 60 Marina Place Kingston upon Thames KT1 4BH UK (“the Promoter”)
The title of the competition is “Southern Showdown 2019”.
How to Enter-
The competition is only open to residents of the UK aged 18 or over, excluding employees of Hi-Spirits Ltd (and see further the Eligibility section below). (“these Terms and Conditions”) are final and the judge’s decisions throughout are non-negotiable.
By submitting an entry, you are agreeing to be bound by these Terms and Conditions.
The opening date for entries is 0.01 1st February 2019. The closing date of the competition is 23:59 31st March 2019 (“Closing Date”). All competition entries received after the Closing Date are automatically disqualified.
No purchase necessary. However, entrants must develop an original, creative and replicable cocktail that includes a maximum of 7 ingredients, with one of the ingredients being a minimum of 25ml of Southern Comfort Original, Black or 100 Proof (“Cocktail”).
All entrant’s Cocktails must be entered with full specifications and photographs and answer the submission form questions.
Entrants must submit a recipe for a Southern Comfort Cocktail and tell us in less than 250 words what inspired you to develop this recipe and how it reflects the Southern Comfort brand and heritage (“Inspiration”).
Each entrant’s venue of employment must stock and sell Southern Comfort and do so throughout the period of the competition.
Maximum three entries per person during the promotional period.
Entry to this competition is only via the Promoter’s website. Those submitting an online entry will be judged by the following judging criteria and be given a score out of one hundred (100) possible points (“Score”): Originality (20 points), Taste (40 Points), Name & story (10 points), Appearance (10 points), scalability (20 points)
‘Scalability’ is defined as: The Cocktail needs to be replicable to anywhere up to 300 drinks in one night
The best twelve (12) valid entries, taking into account the Scores and as determined by the judges, will each be deemed a UK Bartender Challenger (“UK Bartender Challenger”). Entries will be divided into the following regional groups with two (2) ‘UK Bartender Challengers’ from each region: Scotland, Wales & South England, London East, London West, North, Midlands
Entrants must tick the box to agree to the Terms and Conditions and press submit. An email will be sent to confirm receipt of entry.
UK Bartender Challenge –
There will be a total of twelve (12) UK Bartender Challengers. The Promoter will announce the details of each UK Bartender Challenger on its website by Monday 15th April 2019. The UK Bartender Challenge Judging Round (defined below) will occur on the 8th May 2019. The Promotor reserves the right to change this date due to any unforeseen circumstances.
The twelve (12) UK Bartender Challengers will be notified by email and/or phone call within 7 days of the end of the Closing Date and will need to respond to that notification within 7 days in order to confirm their acceptance of their placement and availability to attend the UK Bartender Challenge Judging Round. All reasonable endeavours will be made to contact the UK Bartender Challengers during this time using the contact details provided on the entry form. Entrants should ensure they check their spam/bulk/junk folders for notification because if a response from a UK Bartender Challenger is not received within 7 days of the notification being made, that UK Bartender Challenger may lose their chance to participate in their UK Bartender Challenge Judging Round. Proof of age, identity and eligibility may be required in order to confirm participation.
In the event due to unforeseen circumstances a UK Bartender Challenger is unable to attend the UK Bartender Challenge Judging Round on their original confirmed date/time, the Promoter may in its absolute discretion allow them one (1) additional opportunity to nominate a representative to fill their spot at the UK Bartender Challenge Judging Round, so long as it is confirmed by no later than Monday 1st May 2019.
At the UK Bartender Challenge Judging Round, each UK Bartender Challenger will be required to take part in the (“Bartenders Challenge”)
The Bartenders Challenge will be a one-day event held at the Promoters bar and will involve a series of head-to-head challenges that will test all aspects of bartending including hosting, knowledge, composure, creativity and speed.
Each UK Bartender Challenger must supply their own bartending utensils (shaker, bar spoon, strainer etc.) and any specialist ingredients or modifiers. They must also bring all glassware, props, liqueurs, juices and any other element of their cocktail. The promoter will only provide Southern Comfort and ice at the event.
Cocktails may be presented in any shape of glass, cup or other hygienic and safe receptacle. Note; points are awarded for presentation. Drinks may be served straight-up, or over cubed, cracked or crushed ice.
The best four (4) competitors overall from the ‘Bartenders Challenge’, as determined by the judges, will each be deemed a Grand Finalist (“Grand Finalists”).
National Final –
The four (4) Grand Finalists will be invited to showcase their entry at The National Final in London on 10th June 2019. The Promoter reserves the right to change this date due to any unforeseen circumstances.
The Promoter will announce the details of all Grand Finalists on its website on (or shortly after) 8th May 2019.
There will be two prizes on the day “The Southern Showdown Winner” & “The People’s Champion”. Should one (1) of the Grand Finalists be fortunate enough to receive the accolade of both The Southern Showdown Winner and The People’s Champion, the Grand Finalist with the second highest number of voting tokens (see below) shall we crowned The People’s Champion in their place.
The Southern Showdown Winner
The judging or “score” criteria will be out of one hundred (100) possible points (“Score”): Taste (50 Points), Speed / Efficiency (15 points), Hospitality (20 points), Presentation / Appearance (15 points). The Southern Showdown Winner will be the Grand Finalist that secures the most points in total.
The People’s Champion
The judging or “score” criteria will be based on the number of “voting tokens” that are received by each Grand Finalist on the day of the National Final.
Each audience attendee will have a maximum of one voting token on the night and will be invited to allocate their voting token to one of the Grand Finalists. The Grand Finalist with the most voting tokens at the end of the voting period will be The People’s Champion.
Employees of the Promoter, any of the Promoter’s agencies and any of their parent and/or affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible to enter. The Promoter reserves the right to verify entrants’ eligibility.
The competition is only open to employees/owners of eating/drinking establishments that stock Southern Comfort.
In entering the competition, you confirm that you are eligible to do so and to claim any prize you may win.
The Prizes and Prize Conditions
Prizes: Those judged as the “The Southern Showdown Winner” & “The People’s Champion” (each a “Winner”) will each be awarded a trip to New Orleans.
The prize includes:
- Economy return flights from the Winner’s nearest city or transport hub in the UK to New Orleans, United States of America (including all airport and airline taxes);
- Cost of US travel visa for one;
- Return transfers from the Winner’s residence to the departing airport
- Four nights’ accommodation in a hotel in New Orleans, United States of America (minimum 4-star);
- Return airport to hotel transfers;
- Admission to Tales of the Cocktail in New Orleans;
- All meals and drinks (to a reasonable level) are included, providing the Winner stays within the travelling group and the itinerary provided by the Promoter.
Prizes are non-transferable, non-refundable and cannot be exchanged for any alternatives in whole or in part. The Promoter reserves the right to provide an alternative prize or reward (as applicable) of equal or greater value in the event of unforeseen circumstances.
The Winners are solely responsible for all travel costs and expenses not listed above and any incidental costs, such as telephone/internet, food and drink not specified above as being included, room-service, spending money, parking fees, insurance, and gratuities. The Winners are also solely responsible for having any necessary travel documents and any entry requirements to the United States of America (including any Electronic System for Travel Authorization applications). The Winner must have in place (at his/her own cost) travel insurance before any travel.
The Promoter will announce the two (2) winners on the day of the National Final, 10th June 2019.
Claiming the Prize
The Promoter does not accept any responsibility if a Winner is not able to take up the prize. If a Winner is not able to take up the prize, the Promoter reserves the right to offer the prize to another Grand Finalist.
No prize will be awarded where any entrant has breached the Terms and Conditions or committed any form of misconduct in connection with the competition (determined by the Promoter in its sole discretion).
Data protection and publicity
If you are a UK Bartender Challenger, a Grand Finalist or a Winner, you agree that the Promoter may use your name to announce the Winners of the competition or the applicable stage of the competition, and for any other reasonable and related promotional purposes. The use is expressly limited to showing the Winners in this capacity.
The Winners may be required by the Promoter to take part in any publicity accompanying or resulting from the competition. Winners agree not engage in any publicity or disclose any information about the competition and the prize without the prior written approval of the Promoter.
Information collected from entrants will only be used for the purposes of entry into the competition and will not be disclosed to a third party except where absolutely necessary to fulfil the prize offered.
Personal data supplied during the course of this competition may be passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the prize. The Promoter will comply with all applicable data protection laws.
Ownership of competition entries and intellectual property rights
By entering the competition, you:
(1) hereby assign to the Promoter the complete copyright and all other intellectual property rights with full title guarantee; and
(2) waive all moral rights, in and to any promotional and advertising material, your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
You agree the Promoter may make your entry available on its website and any other media, and in connection with any publicity of the competition entry.
You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence in any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
By entering the competition, you hereby warrant that all information submitted by you in your entry is true, accurate and complete in every respect. The Promoter reserves the right to verify any information contained in your entry and/or your eligibility to enter the competition.
Any information submitted by you must be personal to and relate specifically to you. You hereby warrant that the information you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything libellous, defamatory, obscene, indecent, harassing or threatening.
The Promoter reserves the right, at its sole discretion, to remove and disqualify any entry that does not adhere to these Terms and Conditions.
The Promoter reserves the right to amend or withdraw the competition if circumstances arise which are beyond its reasonable control.
In the event of any dispute regarding the competition, the decision of the Promoter is final, and no correspondence or discussion shall be entered into. The Promoter reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these Terms and Conditions.
The Promoter will not accept responsibility for entries that are lost, late, mislaid, incomplete, unintelligible, misdirected, damaged or delayed in transit, regardless of cause. No responsibility can be accepted for any technical failures of any kind or any unauthorised intervention in any part of the entry process, nor for any technical or human error, which may occur in the administration of the competition or the processing of entries.
The Promoter reserves the right to disqualify any individual it finds to be tampering with the operation of the competition or to be acting in violation of these Terms and Conditions or in an unsportsmanlike or disruptive manner (determined by the Promoter in its sole discretion). Any attempt by any person deliberately to undermine the legitimate operation of the competition may be a violation of criminal and civil law and, should such an attempt be made, the Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law.
The Promoter’s failure to enforce any of these Terms and Conditions shall not constitute a waiver of that provision.
Limitation of Liability
To the fullest extent permitted by law, the Promoter hereby excludes and shall not have any liability to any entrant (including any Winner) in connection with or arising out of the competition, including for any costs, expenses, forfeited prizes, damages and/or other liabilities.
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate any Winner or accept any liability for any loss, damage, costs, expenses, personal injury or death occurring as a result of taking up the prize, except where it is a direct result of the negligence of the Promoter, its agents or distributors or any of their employees.
Your statutory rights are not affected by the foregoing.
Nothing in these Terms and Conditions limits or excludes the Promotor’s liability for (1) death or personal injury caused by negligence; (2) fraud or fraudulent misrepresentation; or (3) any other liability that cannot be excluded under English law.
Governing Law and Jurisdiction
The competition will be governed by English law and entrants to the competition submit to the jurisdiction of the English courts.
